Gay couples Kristin Perry and Sandra Stier of Berkeley, California and Paul Katami and Jeffrey Zarillo of Burbank, California will be moving their fight against Proposition 8 into the court room next month.
The couple’s lawyer have said that they hope to prove that Prop 8 supporters “fail to demonstrate even a single legitimate interest that it [Prop 8] even rationally serves.”
In their suit, the couples claim that the measure was motivated by a bias against gays and lesbians. The groups that supported Prop 8 say that there are numerous reasons for defining traditional marriage, including “promoting and regulating nationally procreative relationships between men and women to provide for the nurture and upbringing of the next generation.”
On Monday both sides filed their witness lists. The groups plan to question the couples that brought the suit and the couple plan to call the official proponents of Prop 8 to testify about the strategy they employed to successfully pass the measure.
A pretrial conference is scheduled for December 16 and it will go to a non-jury trial on January 11th.
